NOTICE OF PROPOSED CLASS SETTLEMENT
You should read the Notice (in PDF format at the link below) if you purchased a condominium unit in the building located at 7373 Martingrove Road and did not opt out of the class action by April 8, 2002.
The Ontario Superior Court of Justice certified the Vitelli and Marra v. Villa Giardino Homes Ltd. et al., Court File No. 01-CV-204304, litigation as a class action on July 20, 2001 and defined the plaintiff class as being: “all persons who purchased condominium units in York Region Condominium Plan No. 911 directly from Villa Giardino Homes Limited”.
The representative plaintiffs have entered into a settlement agreement (the “Settlement Agreement”) with the defendants. The Settlement Agreement must be approved by the Court. If you are a class member and, if settlement approval is given, you will be bound by the terms and conditions of the Settlement Agreement.
You will be bound by the Settlement Agreement if it is approved by the Court, even if you do not file a claim. You will not be able to commence any further litigation against the defendants regarding the size of the condominium units.
